Silver Law Group is investigating former Highland Park, Illinois-based Citigroup Global Markets broker Mark J. Flanagan after he failed to respond to an official request for information and was temporarily suspended by FINRA.
According to FINRA’s BrokerCheck report on Flanagan, a FINRA complaint alleging unauthorized trading and inappropriate use or margin was filed in January of 2014. The complainant alleged damages of $101,868. The complaint was settled for the requested amount in 2015.
A more recent complaint against Flanagan was filed in January of 2017, alleging unsuitable investments. This complaint was based on Flanagan’s time at Citigroup Global and alleges $418,972 in damages
Dennison is not currently employed by any firm, he was discharged by Citigroup Global Markets after an internal investigation into a customer complaint alleging a violation of firm customer communication policies.
Unauthorized trading occurs when a broker facilitates a transaction without the permission of the customer in a non-discretionary account. According to FINRA, it is one of the common investor issues along with misrepresentation, cold-calling, and unsuitability.
Unauthorized discretion is a serious form of broker misconduct. A broker’s employing firm is responsible for overseeing the broker to prevent such misconduct.
